Campaign to overturn Manitoba’s ban on home growing will join Quebec’s Supreme Court appeal

Under the federal Cannabis Act, Canadians are legally allowed to grow up to four cannabis plants per residence unless they live in Quebec and Manitoba, where provincial governments have banned home cultivation.

“Maxime Guérin and his team have done a phenomenal job building a formidable case that I believe will be victorious in the Supreme Court,” Lavoie said. “Maxime will have our full support and access to our research as we apply to intervene in their case and argue alongside them in the Supreme Court of Canada,” he added. 

TobaGrown estimates that the initial proceedings in the case will begin in early 2022. Currently, Manitobans that are caught growing cannabis face a $2,500 fine.

Lavoie started consuming medical cannabis in 2017 following a violent workplace incident that left him with post-traumatic stress disorder. He later left corrections and began working in the cannabis industry.
