New York Cannabis Sales: An Update

New York’s Office of Cannabis Management (OCM) provided an update on the timing of adult-use sales: still in 2022! As reported by Spectrum News 1, on Friday, October 7, 2022, OCM Executive Director Chris Alexander announced that: (i) conditional cultivator licensees’ crops will be ready for sale by year end; and (ii) dispensaries will be open in 2022. The article also noted that New York State Governor Kathy Hochul announced that the 2022 timeline remains on track, with “20 dispensaries coming online per month after the initial launch.”

Despite the OCM’s optimism in commencing sales, the article dropped another nugget that raises questions about the timeline: “The state Dormitory Authority continues to visit locations and negotiate with landlords about potential retail space.” OCM Executive Director Alexander is quoted as adding that “We can’t be more specific than that. It will be a rolling wave, though. We’ll have them keep coming online as they continue to be secured and built out.”

Reading between the lines, the OCM’s comments indicate that the Dormitory Authority (DASNY) has not yet secured any Conditional Adult-Use Retail Dispensary (CAURD) locations yet. We want to jump on the optimism bandwagon, but obtaining the design plans, permits, materials
