Possession of small amounts of cannabis can still lead to a criminal record in 19 U.S. states: Report

And though 18 states have fully legalized the plant and 36 states have legalized medical cannabis, the law continues to be applied unevenly in U.S. states where cannabis remains prohibited.

Citing an American Civil Liberties Union (ACLU) report, MPP notes that Black people are more likely than white people to be arrested for cannabis possession, despite similar use rates, in every single state.

In some states, such as Kentucky, the disparity in arrest rates for simple possession offences is nine times higher for Black people than it is for white people.

“In Iowa and Wisconsin, Black people were arrested for possession at more than seven times the rate of whites. Black people were arrested for cannabis possession in Kansas, South Dakota and Utah at roughly five times the rate of whites,” the National Organization for the Reform of Marijuana Laws (NORML) notes in
